PERSON’S NAME: Patrick Forney 

PURPOSE (The reason why the position exists):  To assist in the termination of Land Contracts.  

VIEWPOINT (The viewpoint that an employee should have, to be successful at the job):

The actual viewpoint from which evictions are carried out from are not what most people think. There is a common misconception that the evictions guy has to have a cold, relentless type of viewpoint. Same thing with collections. This is definitely not the case. The actual viewpoint is that you are trying to help them out. A common problem comes across the line when doing this type of work which is “reasonability.” An easy correlation would be a parent who doesn’t enforce that their child does homework because it’s “hard.” It may in the moment be stressful and difficult to confront a child who is crying and fighting against doing their homework, but if you do not take the lead and handle the child into doing their homework, the child will fall behind in school, and this will just be the start of the troubles and issues that they then begin to run away from. The correct viewpoint to have is that you are in fact helping them, in the long term. One thing that does help understand how to carry out this viewpoint is to have a full understanding of the lines and exchanges within the organization. If you can understand how the family fits within the exchange lines of the company as a whole. This multi dimensional view will help in combating the emotion that you may experience when having to handle some of these families. Example: A family is 6 months past due. Collections has worked with them to attempt to get them on a payment plan, you have worked on trying to get them current, Family Services has tried to set up a payment plan with the utilities company to try and help the family out on that front and that’s it, there’s no more help available and it’s time now to evict them. You speak with them, they say they wanna stay in the house, they wanna make it work, etc., etc., but it just never seems to work out. You tell them you’re evicting them and offering a voluntary termination as a way out to help them dodge the past due balance and avoid court fees. They start crying and yell at you and tell you that you’re a piece of garbage, etc., etc. If you begin to experience their upset, it is because you are not looking at all of the lines. This family is causing traffic to you, to the Family Services, to Collections, to your Div Head, to Qual, to the Investors, to Marketing (how can they have nice things to promote to investors and potential clients when there are families like this?), to Div 1 (they report upwards who is upstat, who is downstat) etc., etc., etc. It is much easier to confront the family and handle them, when you are able to look at all of the terminals and lines involved. The investor is not making money, the Collections department is taking a hit, which means the family current percentage is dropping, this pulls down the Div 4 sec, the company is losing money because they may have to pay for the utilities to avoid getting a lien placed on the property, etc., etc. There are so many more lines and people that are affected by the non payment of the family than you may be able to see at first. At first glance, it’s very easy to feel bad, and unhelpful because you are not giving more and more chances to the family that is in the house. But what about the possibility of another family who would pay on time that are not given the chance to purchase the house because you are trying to salvage this one family? What about the investor who has paid out of pocket several times to cover their utilities? Being able to look panoramically is an ability that will help in the reduction of the emotion that can often mire one down when dealing with difficult families. Often times it comes about that you will be treated terribly, disrespected, have personal insults lobbed at you and this position can become very frustrating and possibly even spill over in your personal life. Having the proper mindset is the most important thing when it comes to doing this job. Learning how to contact attorneys and speak with them, how to find vendors to do eviction postings, how to properly draft paperwork and notices is all secondary to being able to confront and look at what you are doing. 

To conclude, the options/routes for the families are:

1 - Voluntary Termination that the family signs. This document avoids legal action and saves the family from paying back due payments and attorney fees. 
2 - Legal. We look for an attorney in the area who can take on the case of evicting the family. 
3 - Abandonment posting and Rekey. We use this step when there is evidence that the family has left the property.

COMPUTER SKILLS REQUIRED: Microsoft Word basic Skills, Excel Spreadsheet basic skills, familiarity with Google Drive and related document tools within Google  

SKILLS REQUIRED: Good math and duplications skills as well as being detail oriented specifically regarding numbers and correctly importing them into software or excel documents. Is particular about completing actions that have been started. Can keep track of dates and can complete tasks before their due date.

Good communication skills with families and getting families to talk and be agreeable to handlings. Can come up with workable solutions to get families caught and can think outside the box to get past-due balances handled. 

RESPONSIBILITIES OF THE POSITION:

  • Properties legally vacated 

WEEKLY ACTIONS:

  1. Check in with attorneys
  2. Print a new delinquency sheet and draft targets for the week
  3. Ensure all PO's are submitted 
  4. Check with Collections to see what properties need to route to Evictions

 DAILY ACTIONS:

  1. Answer phone calls 
  2. Answer emails
  3. Send text messages 
  4. Update Loans with current info regarding families 

 

STATISTICS: 

  • (MAIN STAT) # of Terminations :  The number of Land Contracts that have been terminated via termination papers, abandonment postings with rekeys, or legal proceedings, resulting in the property being vacated.

 


 

VALUABLE FINAL PRODUCT: 

A Land Contract fully terminated by the three aforementioned methods and a property being vacated by the original buyer(s).
